- GENERAL PROVISIONS -

In these terms:

  • "CLASSY MASTOUR" refers to the professional seller.
  • "You", "the client(s)", "the consumer(s)" refer to the non-professional buyer.

These General Terms and Conditions of Sale (GTC) apply exclusively to all online sales contracts for CLASSY MASTOUR products offered for sale on the classymastour.fr website to non-professional buyers who qualify as consumers.

These GTC prevail over all other contradictory conditions or documents present on the website, on social networks, or particularly those applicable in store and in direct sales.

You can access the GTC on the classymastour.fr website at any time, and especially before placing your order. You have the option to print them.

CLASSY MASTOUR reserves the right to modify the GTC. However, those applicable to you are those in force on the date your order is placed.

The invalidity of a contractual clause does not entail the invalidity of the GTC.

The validation of your order implies unreserved acceptance of these GTC.


- PRODUCTS -

CLASSY MASTOUR advises you to refer, before placing your order, to the product description presented on the classymastour.fr website, where the essential characteristics of the product as per Article L. 111-1 of the Consumer Code, as well as its composition, capacity, and price, are mentioned.

Contractual information is presented in French and is confirmed no later than at the time of your order validation.

You are solely responsible for your choice of product and your purchase. The photographs or illustrations presenting the products are not contractually binding and cannot engage the responsibility of CLASSY MASTOUR.

The items appearing in stock on the classymastour.fr website at the time of the consumer's visit to the site constitute the items offered for sale on the classymastour.fr website.


- AVAILABILITY -

Product offers are subject to stock availability.

In the event that an ordered product is out of stock, CLASSY MASTOUR will inform you and you will be free to choose an equivalent product at the same price, or to receive a credit note valid for 2 months on the entire classymastour.fr website.

Otherwise, you may request a refund for the unavailable product. CLASSY MASTOUR undertakes to return the sums paid no later than 14 days following your refund request. CLASSY MASTOUR will refund you using the same payment method as that used for the initial purchase.

CLASSY MASTOUR is not liable for any cancellation indemnity, unless the non-performance of the contract is personally attributable to it.


- ORDER -

Placing an order proceeds as follows:

1 - The consumer selects the product of their choice (as well as the size, color, and quantity) and clicks on the "Add to cart" button. If the consumer clicks on the "Buy now" button, they go directly to step 3, skipping step 2.

2 - The consumer goes to their virtual cart, which shows a summary of the order that they must check, as well as the total amount of the order, excluding shipping costs.

3 - By clicking on the "Proceed to checkout" button, the consumer arrives at a page where they must enter their contact details, choose their delivery method, and enter their shipping address. At this stage, the consumer has the option, if they have a valid promotional code, to enter it.

4 - By clicking on the "Continue to shipping" button, the consumer chooses the payment method that suits them.

5 - By clicking on the "Continue to payment" button, the consumer enters the necessary payment information. Confirmation of the order by the consumer implies acceptance of the GTC and forms the contract.

The sale is only final after CLASSY MASTOUR sends an email confirmation of acceptance of the order to the consumer, which must be sent without delay after full payment is received.

The consumer's order confirmation and CLASSY MASTOUR's order acceptance confirmation form the distance contract. At this stage, the order can no longer be modified, except with the express and exceptional agreement of CLASSY MASTOUR, nor can it be canceled outside of the right of withdrawal or a case of force majeure.

CLASSY MASTOUR reserves the right to cancel or refuse any order from a consumer for legitimate reasons, particularly if there is a dispute with this consumer regarding a previous order. The order may also be refused if the quantities ordered are abnormally high compared to the quantities usually ordered by buyers who are consumers.

- PRICE -


Prices displayed on the classymastour.fr website are indicated in euros (€), all taxes included (TTC), excluding shipping costs.

The selling price of the product is that in effect on the day of the order.

The prices take into account any reductions granted by CLASSY MASTOUR for orders placed during the promotion's validity period and under the conditions specified in the advertisement on the classymastour.fr website.

Prices displayed on the classymastour.fr website are valid only for mainland France.

To meet the requirements of Article L. 112-1 of the Consumer Code, the price is shown on the classymastour.fr website when your order is registered and before its confirmation.

Additional delivery and transport costs, as well as taxes, are calculated and brought to your attention before your order confirmation, at the payment stage.

The total amount of your order is indicated on the order confirmation page.

The price may be modified at any time by CLASSY MASTOUR. However, the price applicable to you is the one displayed on classymastour.fr at the time of your order.


- PAYMENT -


Payment occurs immediately after order confirmation. Payment is due in full and payable using the following payment methods:

  • credit card via the secure payment infrastructure "Stripe";
  • PayPal;
  • ALMA for payments in 2 or 3 installments.

- DELIVERY -

In accordance with Article L. 216-1 of the Consumer Code, delivery means the transfer to the consumer of physical possession or control of the goods.

CLASSY MASTOUR offers its products for sale internationally.

Orders will be delivered to the address you provided when placing your order.

You must exercise caution and verify the address provided before validating your order, as you will be solely responsible for the consequences resulting from an input error on your part, as well as related costs, including re-shipping costs, which will remain at your expense and will not be borne by CLASSY MASTOUR.

For any order over €120 excluding shipping costs, delivery via Mondial Relay and DPD Pickup is free in France and Belgium.

Click and Collect: CLASSY MASTOUR offers you the possibility to collect your order free of charge in-store, at the following address: 1 rue Marcel Sembat, 93600 Aulnay-sous-Bois. To do this, you must click on the "Collect" tab when choosing the delivery method.

CLASSY MASTOUR will make its best efforts to ensure your order is shipped within these timeframes. You may request in writing the cancellation of the sale, under the conditions provided for in Articles L. 216-2 et seq. of the Consumer Code, only if the delivery delay exceeds 30 days from the order date. CLASSY MASTOUR will then be required to refund the sums paid no later than fourteen days following the date of termination of the contract, excluding any compensation or retention.

The cancellation of the sale cannot be retained if the delay or failure of delivery results from the consumer's fault or a case of force majeure.

CLASSY MASTOUR recommends that you check the condition of your package and the delivered products in the presence of the delivery person, in order to make reservations on the delivery note or to refuse the product if you notice an apparent defect, non-conformity, or a missing product.

From the date of delivery, you have a period of 48 hours (2 working days) to send your claim to CLASSY MASTOUR in writing, by postal mail or email.

You must include all necessary supporting documents with your request, particularly photos proving the subject of your claim. If the claim is not made within these deadlines and under these conditions, it will be refused by CLASSY MASTOUR, and the products will be deemed compliant and free from any apparent defect.

You may request a refund or replacement of the product, at the expense of CLASSY MASTOUR, for any delivered product whose conformity defects or apparent or hidden defects have been duly proven by the consumer, under the conditions provided for in Articles L. 217-4 et seq. of the Consumer Code and in the GTC.


- TRANSFER OF OWNERSHIP AND TRANSFER OF RISKS -

Ownership of the products is transferred to you upon acceptance of the order by CLASSY MASTOUR.

However, the transfer of risks of loss and deterioration of the products occurs only upon effective delivery of the order, when you physically take possession of the products. Ordered products therefore travel at the risk of CLASSY MASTOUR.

Consequently, if you notice any deterioration of your package upon receipt, please check its contents in the presence of the carrier and refuse the package if a product is damaged or missing. Please also contact CLASSY MASTOUR immediately to report the problem.

In the absence of the carrier, for example if your package is delivered to your mailbox, and if the package arrives damaged (examples: torn, open, wet, etc.), we ask you to contact us immediately so that we can, on our side, contact the carrier.

In the event that you choose to be delivered by a carrier other than that chosen and offered by CLASSY MASTOUR, the transfer of risks occurs as soon as the products are handed over to the carrier. Consequently, CLASSY MASTOUR disclaims all liability, and any loss or deterioration of the products will be at your expense.

- CUSTOMER SERVICE / COMPLAINTS –

- WITHDRAWAL -

From the day your order is received, you have a period of 15 days to exercise your right of withdrawal.

To exercise this right, you must formulate your request, without having to justify it, within 15 days following the receipt of your order.

To do so, you must notify us, by postal mail or email, of your wish to withdraw, specifying:

  • your order number;
  • your first and last name;
  • your address;
  • your phone number;
  • your email address.

You can also use the withdrawal form available on the classymastour.fr website.

In case of dispute, it is your responsibility to prove that you have complied with the aforementioned withdrawal period.

The exercise of this right of withdrawal is conditioned on compliance with the requirements provided for in Article L. 221-28 of the Consumer Code, which states in particular that: "The right of withdrawal cannot be exercised for contracts:
(…)

  • for the supply of goods made to the consumer's specifications or clearly personalized;
  • for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection."


- RETURNS -

To be accepted by CLASSY MASTOUR, returns must comply with the following conditions:

  • products must be returned to CLASSY MASTOUR no later than 14 days after the consumer sends the withdrawal request;
  • products must be returned in their original, complete condition (packaging, accessories, instructions, etc.), allowing them to be resold as new, accompanied by the purchase invoice;
  • products must not be damaged, soiled, or incomplete;
  • products must not have been opened by the consumer (especially sealed cosmetics), for reasons of hygiene or health protection.

When the conditions detailed above are met, upon receipt of the return and after verification of the returned product's condition, CLASSY MASTOUR will refund the full amount of the returned items. The costs and risks of return remain your responsibility.

CLASSY MASTOUR will refund you using the same payment method as that used for the initial purchase.

The refund may also be in the form of a credit note or a voucher, if you agree to a refund in this form.

Only purchases made on the classymastour.fr website can be refunded, under the aforementioned conditions. Purchases made in-store are not refundable. You can return your purchase within 30 days from the date of purchase (date on your receipt) to obtain an exchange or a credit note valid for 2 months. The return is accepted only if you comply with the specified conditions and if you present the receipt corresponding to your purchase.


- COMPLIANCE AND LEGAL WARRANTIES -

In accordance with Article L. 411-1 of the French Consumer Code, products comply with the regulations in force relating to the safety and health of persons, fair commercial transactions, and consumer protection at the time of their placement on the market.

Products sold on the classymastour.fr website comply with the provisions of French law in force at the time of their placement on the market.

Products supplied by CLASSY MASTOUR benefit automatically and without additional payment, independently of the right of withdrawal, in accordance with legal provisions:

  • legal conformity warranty:
    CLASSY MASTOUR is liable for conformity defects of the product, under the conditions provided for in Articles L. 211-4 et seq. of the French Consumer Code. This warranty applies to defects already present on the date of product delivery and/or to products that do not match the order;
  • legal warranty against hidden defects:
    CLASSY MASTOUR is liable for hidden defects of the product under the conditions provided for in Articles 1641 et seq. of the Civil Code. This warranty applies if the defect was hidden, existed on the date of purchase, and renders the product unfit for its intended use, or significantly diminishes its use. 


To assert their rights, the consumer must act within a period of 2 years from the delivery of the products or the discovery of the defect. They must prove the existence of the defect. 

The consumer may obtain reimbursement or replacement of products under warranty deemed non-compliant or defective, at the latest within 14 days following CLASSY MASTOUR's observation of the lack of conformity or the hidden defect.

The warranty does not apply to apparent defects and CLASSY MASTOUR cannot be held liable in case of misuse, use for professional purposes, negligence, or lack of maintenance by the consumer, nor in case of normal wear and tear of the product, accident, force majeure, or modification of the product not planned by CLASSY MASTOUR.


- PERSONAL DATA PROTECTION -

In accordance with Law no. 78-17 of January 6, 1978, modified by Law no. 2018-493 of June 20, 2018, consumer data recorded by CLASSY MASTOUR are justified by the service rendered to the consumer, and particularly by the needs related to the proper processing of their order and its delivery. CLASSY MASTOUR may communicate this data to its potential partners or subcontractors responsible in particular for the execution, processing, management, and payment of orders.

The consumer may object to the collection and/or use of their data and benefits from rights allowing them to control how it is used. They may, in particular, request access to data concerning them, have it rectified, or object to being included in a file. They have, in fact, a permanent right of access, modification, rectification, opposition, portability, and restriction of processing concerning the information about them.

The processing of information communicated via the classymastour.fr website complies with legal requirements regarding the protection of personal data, the information system used ensuring optimal protection of this data.


- INTELLECTUAL PROPERTY -

Products offered for sale on the classymastour.fr website are the property of CLASSY MASTOUR.

The content of the classymastour.fr website is the property of CLASSY MASTOUR and its partners, and is protected by French and international intellectual property laws. Any total or partial reproduction of this content is strictly prohibited and may constitute an act of infringement.


- FORCE MAJEURE -

Should the parties fail to fulfill their obligations, or should the fulfillment of their obligations be delayed due to a case of force majeure within the meaning of Article 1218 of the Civil Code, the parties cannot be held liable. The causes can be multiple, including climatic, epidemiological, bacteriological, military, political, IT, etc.


- LANGUAGE AND APPLICABLE LAW -

These General Terms and Conditions of Sale and the operations arising from them are governed by French law. They are written in French. In the event that they are translated into one or more languages, only the French text shall prevail in case of dispute.


- DISPUTES -

We inform you that for any dispute arising from your purchase on classymastour.fr, you have various remedies, amicable or otherwise.

You are first invited to contact CLASSY MASTOUR customer service (see "After-Sales Service / Complaint" article herein) to find an amicable solution.

Should we fail to reach an agreement, you have the option of resorting to conventional mediation, particularly with the Consumer Mediation Commission (C. consom. art. L. 612-1) or with the mediation body whose contact details are as follows: CLASSY MASTOUR MEDIATION BODY CONTACT DETAILS.

You can also contact a consumer association, which will assist you in your efforts, or alert the DGCCRF. You can also use any alternative dispute resolution method (conciliation, for example).

When no amicable solution has been obtained, you can bring the matter before the courts, and the dispute will be submitted to the competent courts under common law conditions.

The consumer who finds that a violation of the general regulation on personal data protection has been committed has the possibility of mandating an association or an organization mentioned in IV of Article 43 ter of the 1978 Data Protection Act, in order to obtain, against the data controller or subcontractor, compensation before a civil or administrative court or before the National Commission for Information Technology and Freedoms.


- PRE-CONTRACTUAL INFORMATION AND CONSUMER ACCEPTANCE -

The act of a natural (or legal) person ordering on the classymastour.fr website implies full and complete adherence to and acceptance of these General Terms and Conditions of Sale, as well as the obligation to pay for the ordered products, which is expressly acknowledged by the consumer, who notably waives the right to rely on any contradictory document that would be unenforceable against CLASSY MASTOUR.
