- GENERAL INFORMATION -

In the presents:

- “CLASSY MASTOUR” refers to the professional seller.

- “You”, “the customer(s)”, “the consumer(s)” means the non-professional buyer.

The General Terms and Conditions apply exclusively to all online sales contracts for CLASSY MASTOUR products offered for sale on the website classymastour.fr to non-professional buyers who are consumers.

The T&Cs prevail over any other conditions or any contradictory documents present on the website or social networks or in particular over those applicable in stores and direct sales.

You can access the Terms and Conditions on the classymastour.fr website at any time, especially before placing your order. You can print them.

CLASSY MASTOUR reserves the right to modify the T&Cs; however, those applicable to you are those in effect on the date your order is placed.

The invalidity of a contractual clause does not entail the invalidity of the General Terms and Conditions.

Validation of your order constitutes acceptance without restriction or reservation of these General Terms and Conditions.

- PRODUCTS -

CLASSY MASTOUR advises you to identify yourself, before placing your order, with the description of the product presented on the website classymastour.fr where the essential characteristics of the product within the meaning of Article L. 111-1 of the Consumer Code, as well as its composition, capacity and price will be mentioned.

Contractual information is presented in French and is subject to confirmation at the latest at the time of validation of your order.

You are solely responsible for your product selection and purchase. Photographs or illustrations depicting products are not contractually binding and CLASSY MASTOUR cannot be held liable.

The items that appear in stock on the classymastour.fr website at the time the consumer visits the site constitute the items offered for sale on the classymastour.fr website.

- AVAILABILITY -

Product offers are subject to availability.

In the event that a product ordered is out of stock, CLASSY MASTOUR will inform you and you will be free to choose an equivalent product at the same price, or to benefit from a credit valid for 2 months on the entire classymastour.fr site.

Failing this, you can request a refund for the unavailable product. CLASSY MASTOUR undertakes to refund the sums paid no later than 14 days following your refund request. CLASSY MASTOUR will refund you using the same payment method as that used for the initial purchase.                                                                                                                          CLASSY MASTOUR is not liable for any cancellation compensation, unless the non-performance of the contract is personally attributable to it.

- ORDER -

The order process is as follows:

1- The consumer selects the product of their choice (as well as the size, color, and quantity) and clicks on the "add to cart" button. If the consumer clicks on the "buy now" button, they go directly to step 3, without going through step 2.

2- The consumer goes to his virtual basket where the summary of the order appears, which he is required to check, as well as the total amount, excluding shipping costs, of the order.

3- By clicking on the “Proceed to payment” button, the consumer arrives on a page on which he must enter his contact details, choose his delivery method and enter his shipping address.  At this stage, the consumer has the option to inquire if they have a valid promo code.

4- By clicking on the “Continue to shipping” button, the consumer chooses the payment method that suits him.

5- By clicking on the "Continue to payment" button, the consumer provides the necessary information for payment. Confirmation of the order by the consumer entails acceptance of the General Terms and Conditions and forms the contract.

The sale is only final after CLASSY MASTOUR has sent the consumer confirmation of acceptance of the order by email, which must be sent without delay and after the consumer has received payment in full.

The confirmation of the order by the consumer and the confirmation of acceptance of the order by CLASSY MASTOUR constitute the contract concluded remotely. At this stage, the order cannot be modified, except with the express and exceptional agreement of CLASSY MASTOUR; and cannot be cancelled outside the right of withdrawal or in cases of force majeure.

CLASSY MASTOUR reserves the right to cancel or refuse any order from a consumer for legitimate reasons, in particular if there is any dispute with the latter relating to a previous order. The order may also be refused in the event that the quantities ordered are abnormally high compared to the quantities usually ordered by buyers as consumers.

- PRICE -

The prices displayed on the classymastour.fr website are indicated in euros (€), all taxes included (TTC) and excluding shipping costs.

The sale price of the product is that in effect on the day of the order.

The prices take into account any discounts that may be granted by CLASSY MASTOUR for orders placed during the promotional period and under the conditions specified in the advertisement on the website classymastour.fr.

The prices displayed on the classymastour.fr website are valid only for mainland France.

To meet the requirements of Article L 112-1 of the Consumer Code, the price appears on the website classymastour.fr when you place your order and before confirming your order.

Additional delivery and transport costs as well as taxes will be calculated and you will be informed before confirming your order, at the payment stage.                                               

The total amount of your order is shown on the order confirmation page .

The price may be modified at any time by CLASSY MASTOUR, however, the price applicable to you is the one in effect displayed on classymastour.fr at the time of your order.

- PAYMENT-

Payment is made immediately after order confirmation.      Payment is due in full and payable using the following payment methods:

- Bank card via the secure payment infrastructure “Stripe”

- PayPal

-ALMA for payments in 2 to 3 installments

- DELIVERY -

In accordance with Article L 216-1 of the Consumer Code, delivery means the transfer to the consumer of physical possession or control of the goods.

CLASSY MASTOUR offers its products for sale internationally.

Orders will be delivered to the address you provided when placing your order.

You must be vigilant and check the address provided before confirming your order, as you will be held solely responsible for the consequences resulting from any input error on your part and the related costs, in particular the reshipping costs which will be at your expense and will not be assumed by CLASSY MASTOUR.

For any order over €120 excluding shipping costs, delivery by Mondial Relay or Colissimo is free in France.

Click and collect: CLASSY MASTOUR offers you the possibility of collecting your order free of charge in store at the following address: 1 rue Marcel Sembat 93600 Aulnay-sous-bois. To do this, you will need to click on the "collect" tab when choosing the delivery method.

CLASSY MASTOUR will make every effort to ensure that your order is shipped within these timeframes. You may request in writing the cancellation of the sale (under the conditions set out in Articles L 216-2 et seq. of the Consumer Code), only if the delivery delay exceeds 30 days from the order date. CLASSY MASTOUR will then be responsible for returning the sums paid to you no later than fourteen days following the date of termination of the contract, excluding any compensation or withholding.

The resolution of the sale will not be accepted if the delay or failure to deliver occurs due to the consumer or a case of force majeure.

CLASSY MASTOUR recommends that you check the condition of your package and the delivered products in the presence of the delivery person in order to make reservations on the delivery slip or to refuse the product if you notice any apparent defect or non-conformity or in the event of a missing product.

Upon delivery, you have 48 hours (2 working days) to send your complaint to CLASSY MASTOUR in writing (by post or email).

You must attach to your request all supporting documents, including photos, proving the purpose of your claim. If the claim is not made within these time limits and conditions, it will be rejected by CLASSY MASTOUR and the products will be deemed compliant and exempt from any apparent defect.

You may request a refund or replacement of the product, which will be the responsibility of CLASSY MASTOUR, for any delivered product whose lack of conformity or apparent or hidden defects have been duly proven by the consumer, under the conditions provided for in articles L 217-4 et seq. of the Consumer Code and those provided for in the General Terms and Conditions.

- TRANSFER OF OWNERSHIP AND TRANSFER OF RISKS -

Ownership of the products is transferred to you upon acceptance of the order by CLASSY MASTOUR.

On the other hand, the transfer of risks of loss and deterioration of the products only occurs from the effective delivery of the order when you take physical possession of the products, the products ordered therefore travel at the risk and peril of CLASSY MASTOUR.

Therefore, if you notice any damage to your package upon receipt, please check its contents in the presence of the carrier and refuse the package if any product is damaged or missing. Please also contact CLASSY MASTOUR immediately to report the problem.

In the absence of the carrier, for example if your package is delivered to your mailbox; if the package arrives damaged (examples: torn, open, wet etc.), we ask you to contact us immediately so that we can contact the carrier.

In the event that you choose to be delivered by a carrier other than the one chosen and proposed by CLASSY MASTOUR, the transfer of risks occurs as soon as the products are handed over to the carrier, consequently, CLASSY MASTOUR declines all responsibility and any loss or deterioration of the products will be your responsibility.

- AFTER-SALES SERVICE / COMPLAINTS –

- WITHDRAWAL -

From the day you receive your order, you have 15 days to exercise your right of withdrawal.

To exercise this right, you must make your request without having to justify it, within 15 days of receiving your order.

To do this, you must notify us, by post or email, of your wish to withdraw, specifying:

  • Your order number
  • Your first and last name
  • Your address
  • Your phone number
  • Your email address

You can also use the withdrawal form available on the website classymastour.fr.

In the event of a dispute, it is your responsibility to prove that you have respected the aforementioned withdrawal period.

The exercise of this right of withdrawal is conditional on compliance with the requirements prescribed by article L 221-28 of the consumer code which provides in particular that “ the right of withdrawal cannot be exercised for contracts:

- BACK -

To be accepted by CLASSY MASTOUR, the return must meet the following conditions:

- The products must be returned to CLASSY MASTOUR no later than 14 days after the consumer sends the withdrawal request.

- The products must be returned in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be put back on the market in new condition, accompanied by the purchase invoice.

- Products must not be damaged, soiled or incomplete.

- Products must not be opened by the consumer (particularly sealed cosmetics) for reasons of hygiene or health protection.

When the conditions detailed above are met, upon receipt of the return and after checking the condition of the returned product, CLASSY MASTOUR will reimburse you for all returned items. The costs and risks of the return are your responsibility.

CLASSY MASTOUR will refund you using the same payment method used for the initial purchase.                                                                                                                            Reimbursement may take the form of a credit note or voucher if you agree to a refund in this form.

Only purchases made on the classymastour.fr website can be refunded, under the conditions mentioned above. Purchases made in store are not refundable, you can return your purchase within 30 days from the date of purchase (date shown on your receipt) in order to obtain an exchange or a credit note valid for 2 months; returns are only accepted if you respect the conditions provided and if you present the receipt detailing your purchase.

- COMPLIANCE AND LEGAL GUARANTEES -

In accordance with Article L 411-1 of the Consumer Code, the products comply with the requirements in force relating to the safety and health of people, the fairness of commercial transactions and the protection of consumers at the time they are placed on the market.

The products sold on the website classymastour.fr comply with the requirements of French law in force at the time they were placed on the market.

The products supplied by CLASSY MASTOUR benefit automatically and without additional payment, according to the right of withdrawal, in accordance with the legal provisions:

- Legal guarantee of conformity:

CLASSY MASTOUR is liable for product conformity defects, under the conditions of Articles L211-4 et seq. of the French Consumer Code. This warranty applies to defects already present on the product delivery date and/or to products that do not correspond to the order.

- Legal guarantee against hidden defects:

CLASSY MASTOUR is liable for hidden defects in the product under the conditions set out in Articles 1641 et seq. of the Civil Code. This applies if the defect was hidden, existed on the date of purchase, and renders the product unusable or significantly reduces its use.

To assert their rights, the consumer must act within 2 years of delivery of the products or discovery of the defect. They must prove the existence of the defect. The consumer may obtain a refund or replacement of products under warranty deemed non-compliant or defective, at the latest within 14 days of CLASSY MASTOUR's discovery of the lack of conformity or hidden defect.

The warranty does not apply to apparent defects and CLASSY MASTOUR cannot be held liable in the event of misuse, use for professional purposes, negligence or lack of maintenance on the part of the consumer, as in the event of normal wear and tear of the product, accident or force majeure; or in the event of modification of the product not foreseen or planned by CLASSY MASTOUR.

- PROTECTION OF PERSONAL DATA -

In accordance with Law 78-17 of January 6, 1978 amended by Law No. 2018-493 of June 20, 2018; the consumer data recorded by CLASSY MASTOUR are justified by the service provided to the consumer and in particular for the needs related to the proper processing of his order and its delivery. CLASSY MASTOUR may communicate this data to its potential partners or subcontractors responsible in particular for the execution, processing, management and payment of orders.

The consumer may object to the collection and/or use of their data and has rights to control the use of their data. In particular, they may request access to their data, have it rectified, or object to its inclusion in a file. They have a permanent right of access, modification, rectification, opposition, portability and limitation of processing with regard to information concerning them.

The processing of information communicated via the classymastour.fr website meets legal requirements regarding the protection of personal data, the information system used ensuring optimal protection of this data.

- INTELLECTUAL PROPERTY -

The products for sale on the website classymastour.fr are the property of CLASSY MASTOUR.

The content of the classymastour.fr website is the property of CLASSY MASTOUR and its partners and is protected by French and international intellectual property laws. Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.

- UNFORESEEN EVENTS -

Pursuant to Article 1195 of the Civil Code, in the event of a change that the parties cannot foresee when concluding the contract, making its performance excessively onerous for the party to the contract undergoing this change; the party who has not agreed to assume a risk of excessively onerous performance may request a renegotiation of the contract with its co-contractor.

- FORCE MAJEURE -

In the event that the parties fail to perform their obligations or if the performance of their obligations is delayed due to a case of force majeure within the meaning of Article 1218 of the Civil Code, the parties shall not be held liable. The causes may be multiple and in particular climatic, epidemiological, bacteriological, military, political, IT, etc.

- LANGUAGE AND APPLICABLE LAW -

These General Terms and Conditions and the transactions resulting from them are governed by French law. They are written in French. In the event that they are translated into one or more languages, only the French text shall be authoritative in the event of a dispute.

- DISPUTES -

We inform you that for any dispute arising following your purchase on classymastour.fr you have various remedies, whether amicable or not.

You are invited to first contact CLASSY MASTOUR customer service (see the article herein “AFTER SALES SERVICE / COMPLAINTS”) in order to find an amicable agreement.

If we are unable to reach an agreement, you have the option of resorting to conventional mediation, in particular with the Consumer Mediation Commission ( C. consom. art. L 612-1 ) or with the mediation body whose references follow: CONTACT DETAILS OF THE CLASSYMASTOUR MEDIATION BODY.

You can also contact a consumer association that will help you with your procedures or alert the DGCCRF. You can also use any alternative dispute resolution method (conciliation, for example).

When no amicable solution can be reached, you can take legal action and the dispute will be submitted to the competent courts under the conditions of common law.

The consumer, noting that a violation of the general regulation on the protection of personal data has been committed, has the possibility of mandating an association or an organization mentioned in IV of article 43 ter of the Data Protection Act of 1978, in order to obtain compensation against the data controller or subcontractor before a civil or administrative court or before the National Commission for Data Protection and Liberties.

- PRE-CONTRACTUAL INFORMATION AND CONSUMER ACCEPTANCE -

The fact that a natural person (or legal entity) orders on the website classymastour.fr implies full adherence to and acceptance of these General Terms and Conditions and obligation to pay for the products ordered, which is expressly acknowledged by the consumer, who waives, in particular, the right to rely on any contradictory document, which would be unenforceable against CLASSY MASTOUR.
